Michael Bias v Cycling New Zealand

Overview:

Non-selection appeal - 2019 BMX World Championships - Cycling New Zealand had applied new selection criteria to riders, and determined that no male BMX riders would be selected - Tribunal found that the legal position was clear and that it should only intervene if there was no basis or justification... for the selectors' decision - new selection regulations had made subjective appraisals clear - the Tribunal expressed concern at the athlete's and sport's future, but found nothing which suggested that the selectors had misunderstood or misapplied the requirements of the procedure - the selectors had considered a multitude of things and there had been an exhaustive inquiry by the Selection Ombudsman - appeal dismissed
