Non-selection appeal - 2019 BMX World Championships - Cycling New Zealand had applied new selection criteria to riders, and determined that no male BMX riders would be selected - Tribunal found that the legal position was clear and that it should only intervene if there was no basis or justification... for the selectors' decision - new selection regulations had made subjective appraisals clear - the Tribunal expressed concern at the athlete's and sport's future, but found nothing which suggested that the selectors had misunderstood or misapplied the requirements of the procedure - the selectors had considered a multitude of things and there had been an exhaustive inquiry by the Selection Ombudsman - appeal dismissed

Anti-doping - Powerlifter based in Palmerston North tested positive for clenbuterol in an in-competition test - provisionally suspended without opposition - admitted violation of the Sports Anti-Doping Rules 2019 (SADR) and expressed reluctance to be involved in the proceedings - Tribunal considered... that an appropriate sanction was four years of ineligibility, which it noted was an extraordinary sanction - backdated to date of the test to account for the athlete's timely admission of the violation - this meant the athlete is ineligible to participate in competitive sport until 13 April 2023

Non-selection appeal – 2019 Oceania Junior Table Tennis Championships – appellant initially selected for NZ Cadet (U15) Girls’ team but removed for failure to meet certain conditions – appellant submitted Table Tennis NZ acted unfairly or unreasonably in removing her from team – Tribunal found... Table Tennis NZ had acted unreasonably and ordered Appellant be restored to team.

Anti-doping - Medsafe investigation into NZ Clenbuterol - XYZ a member of local surf life saving and golf clubs - admitted possession and use of anabolic steroids clenbuterol and dianabol - non-specified substances prohibited at all times - no significant fault or negligence not established - Tribunal... commented on utility and fairness of extending jurisdiction of the Sports Anti-Doping Rules to recreational athletes - Tribunal determined that XYZ should receive 6 months credit for delay in bringing the proceedings, and a further 6 months for timely admission - Tribunal imposed a 2 year period of ineligibility starting 3 October 2018 - accounting for the credits awarded, this means XYZ is ineligible to participate in sport until 3 October 2019 - continued name suppression imposed due to this being a test case on the application of SADR to recreational athletes
