Non-nomination appeal - 2020 Winter Youth Olympics - Appellant argued that undue weight had been placed on one-off performances that he had been unable to attend - Appellant further argued that his results over an extended three month period established that he was the number one ranked male athlete... - The Tribunal noted the extensive material made available to it, but was unable to find evidence of cherry picking by selectors, bias, an appearance of bias or any unfairness - The Tribunal determined that the exercise undertaken within the sport and by the New Zealand Olympic Committee were in accordance with the prevailing protocols, and that the discretions exercised were available and rational - appeal dismissed

Overview:

Anti-doping - canoe sprinter based in Auckland returned a test indicating significantly elevated levels of andosterone, testosterone and 5βAdiol, which are all non-specified substances prohibited at all times - athlete admitted the violation, and submitted emails as to mitigating circumstances - Tribunal... accepted that the athlete had not taken the prohibited substances to gain a performance advantage - Tribunal considered that the violation was not intentional and agreed that a two year period of ineligibility should be imposed, backdated to 16 February 2019 (the date of the test) for the athlete's timely admission

Anti-doping - footballer based in Hamilton tested positive for Probenecid, a Specified Substance prohibited at all times - provisionally suspended without opposition - athlete elected to have 'B' sample tested, as well as independent testing of protein powder - 'B' sample confirmed the original sample,... and independent testing found no contamination of the protein powder - athlete admitted the violation, which was accepted as unintentional - Tribunal considered a joint memorandum on sanction and agreed that a two year period of ineligibility should be imposed, backdated to 2 December 2018 (the date of the test) for the athlete's timely admission
