Appeal against non-nomination for Olympic selection upheld
An appeal brought by a non-nominated Kite foiler against Yachting New Zealand (YNZ) was upheld by the Sports Tribunal on 29 May 2024 because the Tribunal found that incorrect information had been used in YNZ’s decision-making. The Tribunal did not accept that YNZ had improperly followed and/or implemented the nomination criteria which was the ground for appeal, but it was concerned that there had been an error in fact made by the selectors during its consideration of whether to nominate the appellant for Olympic selection. The Tribunal referred the matter back to YNZ to deliberate on the question of nomination applying the correct facts.
